How to Enter: Participants may enter the e-Statements $100.00 pre-paid Valley Visa® Giveaway (“Sweepstakes”) in three (3) different ways:
Time Period: The Sweepstakes begins at 12:01 a.m. ET on December 1, 2009 and ends at 11:59 p.m. ET on May 31, 2010 (the “Entry Deadline”). All entries must be received or postmarked by the Entry Deadline to be eligible. Eligibility: The Sweepstakes is open to all legal residents of the United States and the District of Columbia who are eighteen (18) years of age or older. Employees of Valley Savings Bank, its affiliates and subsidiaries, and any immediate family members of such employees (defined as living in the same household) are not eligible to enter. By participating, entrant agrees to these Official Rules and to the decisions of the judges and Valley Savings Bank, which shall be final and binding in all respects. Void where prohibited by law, rule, regulation or ordinance. One (1) entry per person. Sweepstakes Drawing: Winners will be selected in a random drawing from among all eligible entries. Six separate drawings to be held on 12-28-09, 1-25-10, 2-22-10, 3-29-10, 4-26-10, and 5-31-10. Odds of winning depend on the number of eligible entries received, but are approximately 1 out of 750. Notification: Winners will be notified by telephone on the first (1st) business day after each drawing. An invalid phone number may result in disqualification and an alternate winner may be selected. All prizes will be awarded by May 31, 2010. Prize: The winners of the Sweepstakes will receive one (1) $100.00 pre-paid Valley Visa® gift card. No substitute cash prize will be given. Winners may waive their right to receive prizes. Prizes are not assignable and not transferable. Federal, state, and local taxes and any expenses relating to the acceptance or use of the prize are the sole responsibility of the winner. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within thirty (30) days of date of postmark. Failure to sign and return the affidavit or release within thirty (30) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Mailing List: All entrants agree to receive promotional offers, advertisements or messages along with any notification pertaining to this Sweepstakes. Anyone wishing to be removed from the mailing list used for this promotion can write to Valley Savings Bank, 140 Portage Trail, Cuyahoga Falls, Ohio 44221 requesting to be removed from this list. Entrants may also request to be removed from any future sweepstakes or contest mailings. Participation: By their participation, entrants agree to be bound by these Official Rules as solely determined by Valley Savings Bank and its management. In the event the Sweepstakes is compromised by tampering or other causes beyond the reasonable control of Valley Savings Bank which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Valley Savings Bank reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Valley Savings Bank reserves the right to award prizes based on the entries received before the termination date. Acceptance of prize constitutes permission to Valley Savings Bank and its agencies to use the winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. Limitations of Liability; General Release: By entering the Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. By entering the Sweepstakes, contestants release and hold harmless Valley Savings Bank, and its respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of (a) HIS/HER participation in the Sweepstakes AND the RECEIPT, acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light); and (B) THE use of HIS/HER name or likeness for media or advertising purposes without compensation, except where prohibited. Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Valley Savings Bank, shall be governed by, and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of Ohio or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Ohio. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein. Winners List. A winners list may be made available to the public. Winners’ full names and states of residence and prize description only will be used in any public notification unless otherwise permitted by the winners. For the names of the prize winners, mail a self-addressed stamped envelope to Valley Savings Bank, Attn: e-Statements $100.00 pre-paid Valley Visa® Giveaway, 140 Portage Trail, Cuyahoga Falls, Ohio 44221. Requests must be made by June 4, 2010. A winners list will be sent shortly after the drawing has been held and all winners have been verified. Sponsor: The Sweepstakes is sponsored by Valley Savings Bank, whose decisions regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects.
